Terms of Service

These Terms of Service ("Terms") govern your access to and use of all digital products, websites, and services provided by Cloud Find Smart Sp. z o.o ("we", "our", or "us"), including but not limited to the Mushroom 11 game and related online services.
By accessing or using any of our Services, you agree to be bound by these Terms and all applicable laws. If you do not agree with these Terms, you may not access or use our Services.
You should also review our Privacy Policy, Cookie Policy, and Terms & Conditions, which are incorporated by reference into these Terms.
2. User Eligibility and Accounts
2.1 Eligibility
You may use our Services only if you are at least 13 years old (or 16 if required by local data protection law), or have the consent of a parent or legal guardian. By using our Services, you represent and warrant that you meet these eligibility requirements.
We do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such data, we will delete it promptly.
2.2 Account Registration
Some features of our Services may require registration. When creating an account, you agree to provide accurate and complete information and to update it as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
2.3 Parental Control
If you are a parent or guardian, and you allow your child to use the Services, you agree to be bound by these Terms on their behalf and ensure their use is appropriate and supervised.
3. Acceptable Use Policy
You agree to use our Services only for lawful purposes and in accordance with these Terms. You are prohibited from using the Services to:
- Violate any applicable laws, regulations, or third-party rights.
- Upload or distribute malicious software, viruses, or other harmful code.
- Access or attempt to access accounts, systems, or data without authorization.
- Exploit bugs, cheats, or unintended features in the game or platform.
- Use bots, automation software, or unauthorized third-party tools.
- Harass, threaten, or impersonate other users or Cloud Find Smart personnel.
- Transmit or promote content that is offensive, abusive, racist, sexist, violent, pornographic, or otherwise inappropriate.
- Collect or store personal data of other users without consent.
- Reverse-engineer, decompile, or modify the Services or underlying code.
We reserve the right to suspend or terminate any account, or block access to the Services, if a user is found in violation of this Acceptable Use Policy.
4. Intellectual Property Rights
All content and materials provided through the Services — including but not limited to the Mushroom 11 game, software, code, images, artwork, logos, videos, soundtracks, gameplay mechanics, user interface, and design — are the exclusive property of Cloud Find Smart Sp. z o.o or its licensors. These are protected by copyright, trademark, and other applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only, in accordance with these Terms.
You may not:
- Copy, modify, distribute, transmit, display, reproduce, or create derivative works of our content or code without our prior written consent.
- Use our trademarks, logos, or visual identity without express permission.
- Use any data mining, scraping, or extraction tools on our Services.
Any unauthorized use of our intellectual property may result in the termination of your access and may subject you to civil or criminal penalties.
5. User Content
Some parts of our Services may allow you to submit, upload, publish, or otherwise make available content such as usernames, messages, screenshots, gameplay footage, reviews, or other materials ("User Content").
5.1 Content Ownership
You retain any rights you hold in your User Content. However, by submitting User Content to or through the Services, you grant Cloud Find Smart Sp. z o.o a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform that content in connection with the operation, promotion, and improvement of the Services.
5.2 Content Guidelines
You agree not to post or transmit any User Content that:
- Violates any law, regulation, or third-party rights;
- Is defamatory, abusive, threatening, or harassing;
- Contains obscene, pornographic, or otherwise offensive material;
- Includes unauthorized use of intellectual property;
- Misrepresents your affiliation or impersonates another person or entity.
5.3 Moderation and Removal
We reserve the right (but not the obligation) to monitor, review, edit, or remove any User Content that we determine violates these Terms or is otherwise harmful to the community or our reputation.
6. Virtual Items and Purchases
6.1 Virtual Goods and Currency
Our Services may include virtual goods (e.g. cosmetic items, upgrades) or virtual currency (e.g. credits, tokens) that can be purchased with real money or earned through gameplay. These virtual items have no real-world value and may not be exchanged for cash or other goods outside the game.
6.2 Limited License
All purchases of virtual items grant you a limited, non-exclusive, non-transferable, revocable license to use them within the Services. You do not gain any ownership interest in virtual goods or currency.
6.3 No Refunds
All purchases made through our Services are final and non-refundable, except as required by applicable law or platform policies (e.g. Google Play or Apple App Store). We reserve the right to refuse any refund requests at our discretion.
6.4 Changes and Removal
We reserve the right to modify, replace, or remove virtual items, features, or currency at any time without notice or liability. If your account is terminated or suspended, you may lose access to previously acquired virtual goods or currency.
7. Termination and Suspension
7.1 Termination by You
You may stop using our Services at any time and, if applicable, delete your account. If you choose to terminate your account, you may lose access to purchased content, progress, or virtual items.
7.2 Termination or Suspension by Us
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe that:
- You have violated these Terms or any applicable laws;
- Your conduct harms or risks harming other users, us, or our reputation;
- Required by legal obligations, enforcement requests, or policy updates;
- Your account is inactive for an extended period (typically 12+ months).
7.3 Effects of Termination
Upon termination, your right to access the Services will immediately cease. You may lose all progress, data, virtual currency, and content associated with your account. We are not liable for any losses related to such termination.
Sections of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitations of liability) will continue to apply.
8. Disclaimers and Limitation of Liability
8.1 Disclaimer of Warranties
Our Services are provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, error-free, or meet your expectations.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, Cloud Find Smart Sp. z o.o, its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, profits, or goodwill — arising from your use of or inability to use the Services.
In jurisdictions where limitations of liability are not permitted, our liability shall be limited to the greatest extent permitted by law. In any event, our total liability for all claims shall not exceed the amount you paid to use the Services in the past twelve months (if any).
9. Governing Law and Dispute Resolution
9.1 Governing Law
These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law principles. If you are a consumer residing in the European Union, you may be entitled to additional protections under your local laws.
9.2 Jurisdiction
You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Services shall be brought exclusively in the courts located in Łódź, Poland, unless otherwise required by applicable consumer protection laws.

9.4 European Online Dispute Resolution
If you are a consumer in the European Union, you may also be entitled to use the EU’s online dispute resolution platform: https://ec.europa.eu/consumers/odr.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, legal obligations, or business practices. If we make material changes, we will provide notice through appropriate means, such as posting a notice on our website, updating the “Last Updated” date at the top of this document, or contacting you directly (if applicable).
We encourage you to review the Terms regularly to stay informed. Continued use of the Services after such changes constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Services.
