Welcome to Cloud Find Smart. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, products, and services (collectively, the "Services"). By accessing or using any part of our Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you may not access or use our Services.

These Terms apply to all users of our Services, including without limitation users who are browsers, vendors, customers, merchants, contributors of content, or those accessing our mobile game Mushroom 11 through digital stores.

These Terms constitute a legally binding agreement between you and Cloud Find Smart Sp. z o.o, a company registered in Poland (NIP, REGON, and KRS available upon request), with its principal office located at 6 Sierpnia 12, 90-001 Łódź.

2. Eligibility and User Obligations

2.1 Eligibility

To use our Services, you must be at least 13 years old, or the minimum age required in your jurisdiction to provide valid consent to data processing and contractual terms. If you are under the age of digital consent in your region (for example, 16 in the European Economic Area), you must have your parent or legal guardian’s permission to use the Services.

By accessing or using our Services, you represent and warrant that:

• You are of legal age and have full legal capacity to enter into this agreement.
• All information you provide is accurate, up-to-date, and complete.
• You will use the Services in compliance with these Terms and all applicable laws and regulations.

2.2 Prohibited Conduct

You agree not to misuse or attempt to misuse our Services. Prohibited activities include (but are not limited to):

• Engaging in unlawful, fraudulent, or harmful behavior.
• Attempting to access or tamper with servers, source code, or private data.
• Uploading malware, viruses, or other malicious software.
• Violating intellectual property rights of Cloud Find Smart or any third party.
• Using automation or scraping tools to extract content or interfere with service functionality.

We reserve the right to suspend or terminate your access if you violate these Terms or engage in behavior that negatively affects other users, our systems, or our reputation.

3. Intellectual Property

All content, features, and functionality available through our Services — including but not limited to text, graphics, logos, icons, images, audio, video, game assets, software code, and the overall website design — are the exclusive property of Cloud Find Smart Sp. z o.o or its licensors and are protected by international copyright, trademark, patent, and other intellectual property laws.

3.1 Game Assets & Branding

The name “Mushroom 11”, its visual identity, gameplay mechanics, and accompanying artwork, soundtracks, and design elements are proprietary assets owned by Cloud Find Smart or used under appropriate licenses. Unauthorized use, reproduction, distribution, or modification of these materials is strictly prohibited.

3.2 Trademarks

“Cloud Find Smart”, the Cloud Find Smart logo, and all related names, logos, product and service names, designs, and slogans are registered or unregistered trademarks of Cloud Find Smart Sp. z o.o. or its affiliates or licensors. You may not use these trademarks without prior written consent.

3.3 License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use, subject to these Terms. This license does not include any right to:

• Modify, reproduce, publicly display, or distribute any part of the Services or its content
• Use our content for commercial purposes without explicit permission
• Remove or alter any proprietary notices from materials downloaded or printed from the Services

All rights not expressly granted herein are reserved by Cloud Find Smart.

4. User-Generated Content

Our Services may allow users to submit, post, upload, publish, or otherwise make available content such as reviews, comments, suggestions, feedback, or other materials (“User Content”). By submitting any User Content, you grant Cloud Find Smart Sp. z o.o a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that:

• You own or control all rights in and to the User Content;
• The content is accurate and does not infringe on any third party’s rights (including intellectual property, privacy, or publicity rights);
• The content is not defamatory, hateful, abusive, obscene, or otherwise unlawful;
• You are fully responsible for the User Content you provide and the consequences of sharing it.

We reserve the right (but are not obligated) to monitor, remove, or modify any User Content at our sole discretion if it violates these Terms or applicable laws. Cloud Find Smart assumes no liability for any User Content posted by you or any third party.

5. Disclaimers and Limitation of Liability

5.1 No Warranty

The Services and all content provided by Cloud Find Smart Sp. z o.o are offered on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

We do not guarantee that the Services will be uninterrupted, error-free, or secure; nor do we guarantee the accuracy, completeness, or reliability of any content. You use the Services at your own risk.

5.2 Limitation of Liability

To the maximum extent permitted by applicable law, Cloud Find Smart Sp. z o.o and its officers, directors, employees, agents, affiliates, licensors, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers or personal data
• Any bugs, viruses, or harmful code transmitted through the Services
• Any third-party conduct or content appearing through the Services

In no event shall our total liability exceed the greater of fifty (50) euros or the amount you paid us in the past 12 months for the Services.

6. Termination

6.1 Termination by the User

You may stop using the Services at any time. If you wish to delete your account or request the removal of personal data, please contact us using the information in the Contact Information section of this agreement.

6.2 Termination by Cloud Find Smart

We reserve the right to suspend or terminate your access to the Services, with or without notice, if you breach these Terms, violate applicable laws or regulations, interfere with the normal operation of the Services, or engage in conduct we reasonably consider harmful to other users or our platform.

Upon termination, all rights granted to you under these Terms shall immediately cease. Any sections of these Terms which, by their nature, should survive termination (including but not limited to intellectual property rights, disclaimers, limitation of liability, and governing law) will remain in effect.

7. Governing Law and Jurisdiction

These Terms and any disputes or claims arising out of or in connection with them, their subject matter, or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.

You and Cloud Find Smart Sp. z o.o agree to submit to the exclusive jurisdiction of the competent courts located in Łódź, Poland for the resolution of any legal matter arising from these Terms or your use of the Services, unless applicable laws require otherwise.

If you are a consumer residing in the European Union, you may also be entitled to initiate proceedings in your home country under EU consumer protection law.

8. Severability and Waiver

8.1 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from the remainder of the Terms and shall not affect the validity and enforceability of the remaining provisions.

8.2 Waiver

No failure or delay by Cloud Find Smart Sp. z o.o in exercising any right, power, or remedy under these Terms shall operate as a waiver of any such right or acceptance of any breach. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Cloud Find Smart.

9. Changes to the Terms

We reserve the right to modify, update, or replace these Terms at any time, at our sole discretion. When we make material changes, we will:

• Update the "Effective Date" at the top of this page;
• Post the revised Terms prominently on our website or within the app;
• Notify you by email or in-app alert if the changes significantly affect your rights or obligations.

Continued use of the Services after the revised Terms have been posted constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Services.
